Farallon is providing several private property owners with multiple properties on the Lower Duwamish Waterway (LDW) with technical strategy and support for managing environmental issues associated with the cleanup of the LDW Superfund site in Seattle, Washington. Each of these clients has been identified as a potentially responsible party (PRP) for cleanup of sediments in the LDW and may also have Natural Resources Damages liability. Most of the parties are also participating in a private allocation process initiated by the Lower Duwamish Waterway Group.

Farallon is providing a variety of services to these property owners, including:

  • Independent reviews of historical ownership, operation, and technical data to assist in evaluating liability;
  • Preparing responses to allocation questionnaires and compiling relevant documents;
  • Assisting with developing an allocation strategy, preparing expert reports, and giving depositions during the allocation process;
  • Evaluating cleanup technologies and estimating costs of cleanup;
  • Reviewing potential natural resources damages liability, responding to settlement offers, and planning restoration projects;
  • Evaluating insurance liabilities and reserves and participating in insurances claims reviews and negotiations;
  • Participating in PRP search activities to identify other liable parties.

Based on historical and technical research, conceptual site model development, and pathway analysis for these properties, Farallon has been able to support zero or de minimis allocations for several of the parties.
