Regulatory Closure for VOC Contamination

Farallon assisted a California property owner obtain regulatory closure for a property with historical releases of volatile organic compounds (VOCs) to soil and groundwater, allowing the client to avoid long-term monitoring and future use limitations and prepare the property for sale.

A client engaged Farallon to perform environmental due diligence activities at an industrial warehouse where the client previously operated a business that manufactured and stored vacuum products. Previous investigations identified a release of VOCs to soil and groundwater beneath the hazardous materials storage area at the property. Remedial actions taken included soil source removal and in situ treatment to naturally degrade residual impacts to groundwater. The client engaged Farallon to complete environmental remediation activities and obtain regulatory closure. Subsequent groundwater monitoring identified residual VOC impacts at concentrations exceeding regulatory standards that typically would require continued long-term monitoring and, potentially, further remedial action.

Typically, the local regulatory agency requires contaminants to be cleaned up to the Tier 1 Environmental Screening Levels. Farallon provided an evaluation of the potential risk for future residential land use of the property and convinced the regulatory agency that residual VOC impacts on the property did not warrant further actions or deed restrictions. Through the strength of Farallon’s experience and relationship with the local regulatory agency, the property was granted low-risk case closure with no future site use limitations.

“The case closure allowed our client to avoid costly long-term monitoring, and enabled timely disposition of the asset despite residual conditions that typically would delay the real estate transaction,” said Associate Geologist Gavin Polite Fisco, who managed the project.
